Terms of Trade
1. Application and changes
These Terms of Trade govern every enquiry, quotation, commission and sale through the LUMA storefront, WhatsApp care line and atelier in Lusaka. By placing an order or accepting a quotation you agree to them, and you confirm that you are at least 18 years old and able to enter into a binding contract, and that the information you provide is true and complete. We may update these terms from time to time; the version in force when we confirm your order applies. Continued use of the site after changes are posted constitutes acceptance. Your rights under Zambian consumer protection law are not affected.
2. Orders and how a sale is formed
- Items on the website are an invitation to treat, not an offer. A sale is formed only when we confirm your order in writing (WhatsApp, email or invoice) with the piece, price, delivery details and certificate particulars.
- We may decline or cancel an order where a piece is no longer available, where payment cannot be completed, where there is a pricing or description error, or where delivery cannot lawfully be made to your location — without penalty, and with any amount paid refunded.
- For commissions: sketches and CAD precede any work; no stone is sourced and no metal cut until you approve the design and terms in writing.
3. Price, currency, payment and pricing errors
- Prices are quoted in US dollars. ZMW figures shown are indicative only; the operative currency and exchange rate are fixed in the invoice you accept.
- Accepted payment: bank transfer (USD or ZMW), deposit reservation, and card at collection. Payment instructions appear only on our invoice — never via unsolicited messages.
- If a price is displayed in error, we will not honour the erroneous price: we will either ask you to confirm at the correct price or cancel and refund. Prices may change without notice until your order is confirmed; we do not negotiate confirmed prices.
4. Comparison purchasing
To protect our stock and pricing, we do not allow comparison purchasing — buying several pieces intending to keep one and return the rest. If we reasonably believe this has occurred, we may decline further orders. Our care team is happy to show pieces side by side at a private viewing so you can choose with certainty.
5. Deposits on commissions
A deposit may be required for commissioned work. Deposits are fully refundable until stones are sourced or metal is cut; from that point the deposit applies toward the confirmed design and cannot be refunded except where the piece fails to match the confirmed specifications, in which case we will correct it or refund.
6. Delivery, inspection and reporting of damage
- Delivery within Lusaka is complimentary and fully insured. Nationwide and international delivery is at cost, with signed receipt.
- Inspect your order on receipt: damage or missing items must be reported within 5 days of receipt (and any visibly damaged package should be declined or photographed before opening).
- Risk passes to you on signed receipt; goods remain insured through carriers we engage. We are not responsible for delays caused by carriers or events outside our control, but we will keep you informed and re-plan delivery with you.
7. Reservation of title
Until the full purchase price is received, the goods remain the property of LUMA. If you resell or pass on goods before payment is complete, you hold any proceeds for us as trustee until the balance is settled.
8. Certification, tolerances, descriptions and imagery
- Every central diamond of 0.25 ct and above carries a GIA or IGI certificate, and each piece leaves with an independent valuation for insurance.
- In line with industry standard, total carat weight may vary by up to 0.05 ct from the stated weight; for pieces with several stones we state the minimum total weight, and colour/clarity are stated as minimum or average — the certificate for your piece is authoritative.
- Photography is indicative of style and size; colours may appear differently on screens. The certified particulars of your actual piece prevail.
9. Aftercare warranty
Every piece includes lifetime complimentary cleaning and prong inspection, and one complimentary resize (within one UK size) in the first year. Damage from misuse, third-party alteration, or normal wear is excluded.
10. Returns and refunds
- Where a piece does not match its certificate or confirmed description, or has a manufacturing defect, tell us within 7 days of receipt and we will repair, replace or refund at your election, as consumer protection law requires.
- Returns must include all original packaging, the original invoice and any certificates and valuations. A missing grading report will incur a replacement fee of US$150 (or KZMW equivalent), which is the laboratory's regrading cost.
- Refunds are made to the original payment method within 14 working days after we confirm the return condition.
- Made-to-measure, commissioned, engraved, resized and altered items cannot be returned for change of mind.
11. Cancellations and our right to end the contract
You may cancel a confirmed order before dispatch, subject to costs we have already incurred (sourced stones, cut metal). We may end the contract if you do not pay when due after a written reminder, do not provide information necessary for delivery, or do not take delivery within a reasonable time.
12. Website use and intellectual property
- You may use the site for personal, non-commercial purposes only. You may not scrape, crawl, data-mine, frame, deep-link for commercial ends, or copy product text, photographs, marks or designs without written permission.
- All content — text, photographs, designs, the LUMA name and marks — is the property of LUMA or its licensors, protected by copyright and trademark law.
- Links to third-party sites are for convenience; we are not responsible for their content.
13. Privacy and communications
We process your personal data as described in our Privacy Policy. Order confirmations and care messages are sent by WhatsApp, email or SMS; we will not use your number for unrelated marketing without your consent.
14. Liability
Nothing in these terms excludes or limits liability for fraud, death or personal injury, or rights that cannot be excluded under Zambian law. Our liability in contract is limited to the price paid for the goods concerned, except to the extent the law provides otherwise.
15. Force majeure
Neither party is liable for failure caused by events outside reasonable control (including power or network failures, natural events, or state measures), provided the affected party notifies the other without undue delay and uses reasonable efforts to resume performance.
16. General
- If any part of these terms is unenforceable, the remainder continues in force.
- A failure to enforce a right on one occasion is not a waiver of it.
- You may not transfer the contract without our written agreement; we may transfer it and will notify you.
- These terms are the entire agreement for the transactions they cover.
17. Governing law and disputes
These terms are governed by Zambian law. We will always try to settle disputes directly; failing that, the courts of Lusaka, Zambia have exclusive jurisdiction, subject to consumer law.
